ORS 696.030
- Individual who is full-time employee or a single owner of real estate whose real estate activity involves the real estate of the employer AND (i) is incidental to the employee’s normal non-real estate activities, OR (ii) is employee’s principal activity, but the employer’s principal activity or business is not the sale, exchange, lease option or acquisition of real estate
- Individual who acts as attorney in fact under a duly executed power of attorney (power of attorney must be recorded in the county in which the property is located and must specifically describe the real estate) where the power of attorney isn’t a device to engage in professional real estate activity without obtaining the necessary real estate license
- Individual who acts as attorney in fact under a power of attorney for close family member
- Lawyer rendering services in the performance of duties as an attorney
- Receiver, conservator, bankruptcy trustee
- Individual acting pursuant to court order
- Full time employee of an entity that owns real property who engages in the rental or management of real property BUT NOT in the sale, exchange, lease option or purchase
- Engineer or architect rendering services in the performance of duties as an engineer or architect
- Individual employed by a real estate broker or principal real estate broker who acts as a manager for real estate if the activity is limited to negotiating rental or lease agreements, checking tenant and credit references, physically maintaining the real estate, conducting tenant relations, collecting rent, supervising the premises’ managers and discussing financial matters relating to the management of the real estate with the owner
- Sale or lease of cemetery lots as part of the cemetery business
- Employee of the State of Oregon rendering services in the performance of duties as an employee
- Individual who provides advice regarding land use alternatives, environmental impact, building and use permit procedures or demographic market studies
- Hotel or innkeeper as part of the hotel business
- Travel agent arranging rental of transient lodging
- Common carrier arranging rental of transient lodging
- Hotel representative arranging rental of transient lodging
- Individual transferring or acquiring interest in real estate owned by the individual
- Individual who is a GP in a partnership engaged in the sale of limited partnership interests and the acquisition, sale, exchange, lease, transfer or management of real estate for the partnership
- Individual selling membership camping contracts
- Professional forester or farm manager as part of job
- Registered investment advisor
- Individual who refers a residential tenant while living in building or within 6 months of living in building
- Individual who give opinion of value in a judicial tax proceeding
- Individual who is a paid fiduciary whose real estate activity is limited to negotiating or closing a transaction to obtain the services of a real estate licensee
- Fiduciary acting under court order
- Rep of a financial institution or trust company that is an attorney in fact under a power of attorney
- Managing member of an LLC engaged in the acquisition, sale, exchange, lease, transfer or management of real estate of the LLC
- Partner of a partnership engaged in the acquisition, sale, exchange, lease, transfer or management of real estate of the partnerships
- Officer or director of a corporation engaged in the acquisition, sale, exchange, lease, transfer or management of real estate of the corporation
