1.             OTHER ADR PROCEDURES

A.             “Arbitration” – the parties’ dispute is submitted to a third party for a binding decision following a presentations of evidence and arguments by both parties similar to a trial.

B.              “Med-Arb” – A hybrid procedure in which the mediator also has a role as an arbitrator in the same proceeding.  The scope of the mediator/arbitrator’s role and authority are defined by agreement.

C.             “Minitrial” or “Summary Jury Trial” – Abbreviated trial governed by private agreement instead of the rules of civil procedure.  Typically have limited discovery, limited motion practice, and expedited timeframes in order to be efficient and cost-effective.
